By accessing or using DecideTonight ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. DecideTonight is a free, no-account group decision-making app. Your continued use of the Service constitutes acceptance of any updates to these terms.

DecideTonight provides a web-based tool that allows groups of people to make collective decisions through an anonymous swiping mechanism. The Service is provided free of charge. No account registration, email address, or personal account credentials are required to use the core features of the Service.

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not: (a) use the Service to transmit spam, abusive, or illegal content; (b) attempt to interfere with or disrupt the integrity or performance of the Service; (c) attempt to gain unauthorized access to the Service or its related systems; (d) use automated tools to scrape, crawl, or otherwise extract data from the Service without our prior written consent.

DecideTonight uses temporary, browser-based sessions. When you create or join a room, a participant identifier is stored locally in your browser. Rooms and associated vote data expire 24 hours after room creation and are automatically deleted after the retention window. We do not link this data to any personally identifiable information. You are responsible for any content you submit as room names or usernames — do not submit sensitive personal information.

All content, design, graphics, logos, and code comprising the Service are the property of DecideTonight or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

The Service may integrate with third-party APIs (such as movie databases or food services) to provide content suggestions. These third parties have their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services. Links to external sites do not constitute endorsement.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

To the fullest extent permitted by applicable law, DecideTonight and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Service. In no event shall our total liability to you for all claims exceed $100 USD.

We reserve the right to modify these Terms of Use at any time. We will indicate the date of the most recent update at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised terms.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved through binding arbitration in accordance with applicable rules.
